Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Garrison365 platform (“Service”) by gyms, martial arts academies, and fitness studios (“Academies”), their staff, and their members. By creating an account, enrolling as a member through an Academy that uses Garrison365, or otherwise using the Service, you agree to these Terms.

Garrison365 is a software platform that Academies use to manage memberships, billing, scheduling, communications, belt and curriculum progression, and day-to-day operations. An Academy is responsible for its own business decisions, pricing, and relationship with its members; Garrison365 provides the software that supports that relationship and does not operate any Academy itself.

You must provide accurate information when creating an account and keep it up to date. You are responsible for activity that happens under your account and for keeping your login credentials secure. Accounts for a member under 18 are managed by a parent or legal guardian.

Academies subscribe to Garrison365 on the plan they select at sign-up; members pay their Academy for membership plans through the Service. All payments are processed by Stripe, Inc. Fees are billed in advance on a recurring basis unless otherwise stated, and are non-refundable except where required by law or expressly stated by the Academy. An Academy may change its own membership pricing at any time; Garrison365 may change platform subscription pricing with reasonable advance notice.

By providing a phone number or email address through the Service, you agree to receive account-related messages from the Academy using the Service — including billing notices, class reminders, waiver and document reminders, and progression updates. Message frequency varies; message and data rates may apply. You may opt out of text messages at any time by replying STOP, and request help by replying HELP. See our Privacy Policy for details on how this information is used and protected.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to another Academy’s data or another user’s account.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to send unsolicited communications outside the scope of an existing member relationship.
• Reverse engineer, resell, or white-label the Service without our written permission.

As between an Academy and Garrison365, the Academy owns the member data it collects and manages through the Service. Garrison365 processes that data to provide the Service, as described in our Privacy Policy. If an Academy stops using Garrison365, it may request export of its data within a reasonable period, subject to our standard retention and offboarding process.

Garrison365 and its licensors own all rights in the Service, including its software, design, and branding. These Terms do not grant you any right to use the Garrison365 name, logo, or trademarks without our prior written consent.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Garrison365 is a software platform, not a licensed fitness, medical, or childcare provider; decisions about training, safety, and member care remain the responsibility of the Academy.

To the fullest extent permitted by law, Garrison365 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount paid to Garrison365 for the Service in the twelve months preceding the claim.

An Academy may cancel its subscription at any time through its account settings or by contacting us. We may suspend or terminate access to the Service for a breach of these Terms, non-payment, or conduct that risks harm to the Service or other users. Provisions of these Terms that by their nature should survive termination will survive.

We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date, and where a change is material, we will provide additional notice. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
